Terms of Service

These Terms of Service apply to your use of the Polly Language Learning website, applications, browser extension, and related services (the "Service").

• You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Service.
• If you are under the age of majority where you live, you may use the Service only with parent or guardian permission.
• You may not use the Service if doing so would violate applicable law.

• Provide accurate information and keep it up to date.
• Keep your password and authentication credentials secure.
• You are responsible for activity that occurs through your account.
• Notify us promptly if you believe your account has been compromised.

You agree not to misuse the Service. That includes, for example, trying to reverse engineer it, scraping it at scale, interfering with other users, uploading malware, or using the Service in a way that breaks the law or our systems.

You may not share paid access in violation of your subscription terms or use the Service for unauthorized commercial exploitation.

We own or license the software, branding, interface, and learning materials that make up the Service. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal learning use.

You keep rights to content you create or save in the Service, such as notes or saved words, but you grant us the rights needed to host, process, and display that content to operate the Service for you.

The browser extension and related tools may process text or materials that you choose to submit or capture through the Service. You are responsible for ensuring you have the right to submit that material and that your use complies with applicable law and website terms.

Spoken practice needed to operate a lesson is processed ephemerally and is not retained for research by default.

Adults may separately opt in through account settings to let us retain encrypted practice recordings for human annotation, speech research, and governed offline model training. This opt-in is voluntary, versioned, and revocable.

You keep ownership of your recording and grant us a limited license to store, review, annotate, and use an opted-in recording for the disclosed research purposes during the retention period. Revoking consent ends future collection and queues existing retained recordings for deletion.

If we offer paid subscriptions or purchases, fees, billing cadence, and cancellation terms will be shown before you buy.

Refund eligibility and cancellation timing will be stated in the applicable offer and checkout terms. Contact the payment provider listed on your receipt or our support team for help.

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially violate these terms, create risk for the Service or other users, or where required by law.

Sections that reasonably should survive termination will remain in effect, including intellectual property, disclaimers, limitation of liability, and dispute sections.

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, or specific learning outcomes.

To the fullest extent permitted by law, Polly Language Learning and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our aggregate liability for claims relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

These terms are governed by the laws of New York, USA, without regard to conflict of law rules. We prefer to resolve disputes informally first. Please contact us before filing a formal claim.

We may update these Terms from time to time. If changes are material, we will give notice through the Service, by email, or by another appropriate method.
